Welcome to OMG Find.

The terms “we”, “us” and “our” refer to OMG Find. OMG Find operates this online store and website, including all related content, features, products, services, tools and information made available through the website (collectively, the “Services”).

OMG Find is powered by Shopify, which provides the technology used to operate our online store.

These Terms of Service, together with any policies referred to or linked to within these Terms, explain the terms and conditions that apply when you visit, browse or purchase from our website.

Please read these Terms carefully before using our website or placing an order.

By accessing or using our website, or placing an order with OMG Find, you acknowledge that you have read, understood and agreed to these Terms of Service and our applicable policies, including our Privacy Policy and Refund & Returns Policy.

If you do not agree with these Terms, please do not use our website or purchase products from us.

These Terms are intended to operate subject to applicable South African law, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and other applicable legislation. Nothing in these Terms is intended to exclude or limit any right or protection that cannot lawfully be excluded or limited.


SECTION 1 – ACCESS AND CUSTOMER ACCOUNTS

By using our website, you confirm that you are legally capable of entering into a binding agreement under applicable law.

You agree that all information you provide to OMG Find will be accurate, current and complete.

We reserve the right to refuse service, suspend an account or cancel an order where we reasonably believe that fraudulent, unlawful or abusive activity has occurred.


SECTION 2 – PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and other information displayed on our website are accurate and up to date.

However, product colours and appearance may vary depending on your device, screen settings, lighting and other factors.

Product images may be provided for illustrative purposes. Minor differences between photographs and the actual product do not necessarily constitute a defect where the product remains materially consistent with its description.

We reserve the right to update product information, descriptions, specifications and availability at any time.

We may discontinue products or limit quantities where reasonably necessary.

Nothing in this section limits your rights under applicable South African consumer protection legislation where a product is defective, unsafe, unsuitable for its intended purpose or materially different from its description.


SECTION 3 – ORDERS AND ACCEPTANCE

When you place an order through our website, you are submitting a request to purchase the selected products.

Your order will be subject to payment confirmation and acceptance by OMG Find.

An automated order confirmation does not necessarily mean that OMG Find has accepted the order where further verification is reasonably required.

We reserve the right to refuse, cancel or limit an order where:

  • payment cannot be successfully processed;
  • the product is unavailable;
  • there is an obvious pricing or product description error;
  • we reasonably suspect fraud or unauthorised activity;
  • the order contains incorrect information;
  • circumstances outside our reasonable control prevent us from fulfilling the order; or
  • cancellation is otherwise permitted by applicable law.

If we cancel an order after payment has been received, we will arrange the applicable refund in accordance with our Refund & Returns Policy and applicable law.

Please review your order carefully before completing payment.


SECTION 4 – PRICES AND PAYMENT

All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated.

Prices may change from time to time. However, where an order has been successfully accepted, the applicable price will generally be the price displayed at the time the order was placed, subject to correction of obvious errors and applicable law.

Any applicable delivery charges will be displayed during checkout or otherwise communicated before completion of the transaction.

We accept the payment methods displayed on our website at the time of purchase.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

We do not store your full payment card details where payment is processed through our payment service providers. Payment information may be processed by third-party payment providers in accordance with their own terms and privacy policies.

If an obvious pricing or listing error occurs, we reserve the right to correct the error and, where legally permitted, cancel an affected order and refund any amount paid.


SECTION 5 – SHIPPING AND DELIVERY

OMG Find may source products from local and/or international suppliers.

Unless otherwise stated on the product page or at checkout, delivery timeframes are estimates and not guaranteed dates.

Where products are imported, delivery may be affected by international transportation, supplier processing, customs procedures, local courier operations, public holidays, weather, strikes, operational disruptions or other circumstances outside our reasonable control.

Estimated delivery periods may therefore vary between products and orders.

If a product has a specific estimated delivery period, that period will be communicated on the relevant product page, during checkout or in your order confirmation.

We will make reasonable efforts to keep you informed of significant delays.

If an order cannot be fulfilled within the period agreed with you, or within the period permitted by applicable law, you may have cancellation or refund rights.

Nothing in these Terms removes any consumer rights relating to delivery under South African law.

Once your order has been delivered to the address provided by you, you are responsible for ensuring that the product is kept safe.

You are responsible for providing a correct and complete delivery address and contact details. Additional costs arising because incorrect or incomplete information was provided by the customer may be payable by the customer where permitted by law.


SECTION 6 – CUSTOMS, IMPORTS AND DUTIES

Where products are sourced internationally, customs clearance, import duties, taxes or other charges may apply depending on the nature and value of the goods and applicable South African law.

Where any such charges are not included in the price displayed at checkout, the customer may be responsible for applicable charges imposed by customs, authorities or third-party service providers, where legally permissible.

OMG Find does not control customs processing times and cannot guarantee how long customs clearance will take.


SECTION 7 – REFUNDS, RETURNS AND EXCHANGES

Our Refund & Returns Policy forms part of these Terms of Service.

Customers should review the Refund & Returns Policy before purchasing.

Nothing in our Refund & Returns Policy or these Terms is intended to remove or limit rights granted to consumers under applicable South African law.

Where a product is defective, unsafe, does not correspond with its description, or otherwise fails to meet applicable legal requirements, your statutory consumer rights may apply.

Where a return is requested because of a change of mind, any applicable requirements, exclusions, costs and time limits will be dealt with in accordance with our Refund & Returns Policy and applicable law.

All content appearing on the OMG Find website, including but not limited to our brand name, logo, text, graphics, photographs, videos, designs, product descriptions, website layout and other materials, is owned by OMG Find or used under licence or with permission.

OMG Find is powered by Shopify.

Shopify provides the technology that allows us to operate our online store. However, purchases made through our store are transactions between you and OMG Find.

Shopify is not responsible for the products sold by OMG Find or for the fulfilment of orders placed with OMG Find.

Shopify’s services may also be subject to Shopify’s own terms and policies.

OMG Find will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

  • strikes or labour disruptions;
  • supplier disruptions;
  • international shipping disruptions;
  • customs delays;
  • courier disruptions;
  • government actions or restrictions;

If there is a conflict between these Terms and a mandatory legal right, the mandatory legal right will prevail.
